OAKLAND — A BART police officer struggling to handcuff a 22-year-old man, stood up over the facedown Hayward resident and fired a single shot into his back while a handful of officers watched, a video taken by a train passenger apparently shows.

The attorney for the family of Oscar Grant III, fatally shot by an unidentified BART officer early New Year's Day, said Sunday he plans to file a $25 million lawsuit against the department and asked prosecutors to consider filing murder charges against the officer.

The shooting occurred shortly before 2 a.m. Thursday after five officers responded to the Fruitvale station to reports of a fight on a train, officials said, though they have not confirmed whether Grant was involved in the fight.

The senseless murder of Oscar Grant III by a BART police officer in Oakland, CA is so reminiscent of the Sean Bell case that it's ridiculous. I don't know how the police can defend themselves on this one, but I'm sure they are going to come up with some BS defense about how the officer thought he was grabbing his taser, but mistakenly grabbed his gun. First of all, why would a defense person who has three officers on them need to be tased anyway. I am so angry I can scream. Another young brother has left this world because of a rogue cop shot him in the back like a coward. Thank God for camera phones because had the whole thing not been caught on camera I'm sure the officers would be talking about how Oscar had a gun or he was resisting arrest so that was the reason why they had to shoot him or some mess about how the officer was in fear for his own life. Please don't give me that mess about all cops not being bad. I'm not talking about all cops. I am not talking about the punk ass cop that shot this young man in the back and left a little girl fatherless. So you can save all that nonsense about there being really good cops out there and they put there lives in danger every time they put on their uniforms. I don't want to hear it. I just hate I have to teach my nephews how to behave around cops so that they won't lose their lives in case some punk ass cop is feeling trigger happy. I just don't know what to say. You want to teach your children to trust the police, but if you are raising little black boys stuff like this make it real difficult.

Essence is having their annual Will You Marry Me contest and once again I have to pick my favorite couple. This year my favorite couple is Ebiakpo Jituboh & DeKeisha George. I just love their story. I have find now and days that when people take their vows they say the part "for better or for worse" but they don't really mean the "for worse" part. But with these two already knowing that there is going to be a "for worse" part on the horizon with DeKeisha's recent diagnosis with Multiple Scelerosis, Ebiakpo still chose to ask her to be his wife. Now, if anyone knows me they know that I am very pessimistic when it comes to this love stuff, but for just one moment this couple actually made me a believer. I just love the fact that he chose not to run away from her disease. So cheers to DeKeisha and Ebiakpo. I truly hope Ebiakpo gets his wish and is able to meet their future children.
